Airshed

These terms and conditions will apply to any emissions reduction services or other goods or services that you purchase from AIRSHED Limited (AIRSHED) through its website. These terms and conditions may be revised from time to time. The revised terms and conditions will be posted on the AIRSHED website.

1. Website

1.1 AIRSHED has made all reasonable efforts to make sure that the contents of this site are accurate. However, AIRSHED makes no representations or warranties of any kind relating to the operation of this site or its contents.

1.2 To the extent allowed by law, AIRSHED will not be liable for any damage or loss whatsoever suffered or incurred by anyone that uses this site, as a result (directly or indirectly) of them using the site or relying on its contents. If, for whatever reason, we cannot rely on this exclusion of liability, our total liability to you for any damage or loss whatsoever (in contract, tort or otherwise) will not exceed the value of your purchase from this website. We will never be liable to you for any indirect or consequential damage or loss whatsoever.

2. Offset Services

2.1 On hitting the “Submit” button on the site you (the purchaser) enter into an agreement with AIRSHED for AIRSHED to provide (or, in the case of myclimate offsets, for AIRSHED to instruct myclimate to provide) services to offset a specified volume of emissions. You will receive a non-transferable certificate by email confirming this purchase. The certificate is not evidence of carbon neutrality.

2.2 Following your purchase, AIRSHED will retire (or, in the case of myclimate offsets, AIRSHED will instruct myclimate to retire) a number of offsets that equates to the volume of offset services purchased by you. You will not be recorded on any register as the owner of any offset; nor will you acquire any ownership of or any interest in any offset.

2.3 Purchasers of services to offset emissions from AIRSHED may not sell or transfer these offset services to anyone else.

2.4 AIRSHED will not sell the emissions reductions attaching to any individual offset more than once or to more than one person.

3. Emissions Calculators

3.1 AIRSHED makes all reasonable efforts to ensure that its emissions calculators are accurate and are based on the most up-to-date emissions factors published by reputable sources. To the extent allowed by law, AIRSHED will not be liable for any damage or loss whatsoever suffered or incurred by anyone that relies on these emissions calculators.

3.2 If AIRSHED changes the emissions factors that it applies to its emissions calculators, this will not affect any emissions calculations or offset services sales made before these changes were made.

4. Online Sale of Goods

4.1 We agree to sell you goods when we accept an order made by you through our website.

4.2 The description, quantity and price (including GST, if any) of your goods will be set out in your order. We will accept your order at our sole discretion. If we accept your order we will confirm this to you online.

4.3 We will charge your credit card account for payment of your accepted order. If we cannot obtain full payment for the goods from your credit card we may (without limiting our rights) cancel your order.

4.4 GST will be charged on all sales (if applicable).

4.5 All prices are quoted in New Zealand Dollars.

5. Delivery

5.1 Deliveries will be charged according to your location. Standard delivery for all New Zealand orders will be by fastpost delivery. International orders will be delivered on the terms agreed at the time your order is accepted.

5.2 AIRSHED endeavours to dispatch all orders within 10 days of receipt of payment in full or receipt of a credit card authorisation for the full amount due. If the goods you have ordered are not in stock, AIRSHED will use reasonable endeavours to obtain additional stock with which to make up your order. If we are unable to do so within a reasonable period of time, we will give you a full refund.

6. Returns Policy

6.1 We will replace or refund any defective goods returned to us. However, we will only replace or refund non-defective goods (at our discretion) if they are returned to us in their original packaging, unopened and in the condition they were when delivered to you.

6.2 We will be responsible for reasonable delivery charges on defective items returned to us (and their replacement). However, you will be responsible for delivery charges on non-defective items returned to us (and any replacement).

6.3 This returns policy is not applicable to offset product sales.

7. Intellectual Property

7.1 This site is protected by copyright which is owned by AIRSHED. The brands appearing in this website are the trademarks of AIRSHED or their respective owners.

7.2 You may print or download copies of the material on this site for your personal use. No other copying, duplication, redistribution or dissemination is allowed without our consent.

8. Force Majeure

8.1 AIRSHED will not be liable for any delay or failure to perform any of its obligations under this Agreement if such delay or failure results from circumstances or causes beyond its reasonable control.

9. Law

9.1 The laws of New Zealand govern this website and all transactions made in relation to it.

9.2 Any rights you may have under the Consumer Guarantees Act 1993 (NZ) are not affected by these terms and conditions.
